Israel: Allow Media and Rights Monitors Access to Gaza

Total Ban on Foreign Journalists Since Offensive Began

(Jerusalem, January 5, 2009) – Israel should immediately allow journalists and human rights monitors access to Gaza, Human Rights Watch said today. Their presence can discourage abuse by warring parties and help save lives.

Human Rights Watch urged the Israeli government to abide by an Israeli high court ruling on December 31, 2008 and allow foreign media into Gaza. The presence of journalists and human rights monitors in conflict areas provides an essential check on human rights abuses and laws-of-war violations, Human Rights Watch said.

Since early November 2008, when the ceasefire between Israel and Hamas began to deteriorate, the Israeli government has sharply restricted access to Gaza for foreign journalists and human rights monitors, and none has been permitted entry since the current military campaign began on December 27. Israeli journalists have been denied access to Gaza for the past two years because of an Israeli government policy prohibiting Israeli citizens from entering Gaza on security grounds.

“Journalists and rights monitors should be allowed into Gaza to investigate and report on the conduct of both sides,” said Fred Abrahams, senior emergencies researcher for Human Rights Watch. “Israel’s excessive restrictions on access to Gaza only end up impeding this deterrent effect and placing civilians at greater risk.”

According to the United Nations, Israeli attacks had killed more than 430 Palestinians in Gaza, about one-quarter of them civilians, prior to the onset of Israeli ground operations on January 3. Palestinian rockets launched into Israel have killed three Israeli civilians in this period.

The Israeli High Court ruled on December 31, 2008, that the Israeli government should allow 12 foreign journalists into Gaza. The government said it will allow eight journalists into Gaza every time it opens the border at the Erez crossing, but so far the crossing has remained closed to entry. The decision by the High Court came in response to a petition by the Israeli Foreign Press Association, which represents more than 400 members from the world’s leading international print and electronic media. The association called the ban “an unprecedented restriction of press freedom” on Israel’s part.

On November 21, 22 executives from the world’s major news organizations, including the Associated Press, BBC, CNN, and Reuters, sent a letter to Israeli Prime Minister Ehud Olmert, complaining about the “prolonged and unprecedented denial of access to the Gaza Strip for the international media.”

The restrictions create a very different reporting atmosphere than that during Israel’s last major war, the conflict with Hezbollah in Lebanon in July-August 2006. At that time, the media and human rights organizations were able to report on the conflict from both sides.

International human rights law, applicable during armed conflict, upholds the right to freedom of expression of journalists and human rights monitors. States may restrict freedom of expression to protect national security, but only as permitted by law and as necessary for genuine and specific security reasons. This principle is elucidated in the 1995 Johannesburg Principles on National Security, Freedom of Expression and Access to Information:

“Any restriction on the free flow of information may not be of such a nature as to thwart the purposes of human rights and humanitarian law. In particular, governments may not prevent journalists or representatives of intergovernmental or non-governmental organizations, which monitor adherence to human rights or humanitarian standards, from entering areas where there are reasonable grounds to believe that violations of human rights or humanitarian law are being, or have been, committed. Governments may not exclude journalists or representatives of such organizations from areas that are experiencing violence or armed conflict except where their presence would pose a clear risk to the safety of others.”

“The presence of journalists and human rights researchers is not just about the right to information,” Abrahams said. “Independent monitoring during an armed conflict can discourage misconduct and save lives.”

Breaking News: A Massacre: Samuni family says: Israeli soldiers gather 30 persons from Al Samoni family in one house. Ten families were in the house from the same clan. Many civilians were killed as artillery shells bombed the house. The number of victims around 14, most of them are children and women. Some are in critical conditions!
Breaking News: Hundreds of shelling target houses in east of Gaza City and Jabalia now. No new coming up yet. The conditions getting tougher in that area.
Breaking News: Three children and their mother killed during a shell hit their house in Al shija'ya area east of Gaza. The victims were in their house during the shelling. Their bodies were torn to pieces.
Breaking News:Bloody clashes between Palestinian factions and Israeli organized army east of Gaza City. Israeli army is firing back using Apachi and heavy artillery shells. Many people wounded and no upcoming news if militants are being targeted.

Washington, DC | January 5, 2009 | | The American-Arab Anti-Discrimination Committee (ADC) today called on the United States Government; including members of Congress, and the international community; including the United Nations and the International Committee of the Red Cross (ICRC), to investigate Israel's reported use of White Phosphorus in its ongoing attack on Gaza.  According to the United Nations Israel's overwhelming attacks on Gaza, now in their tenth day, have thus far killed 540 people, 30% of whom are civilians, and injured over 2,750 people; including over 1,000 children.  Among those killed today was a family of seven from Shati refugee camp, who were killed by Israeli navy shelling. Three siblings from one family, as well as a girl and her grandfather, also died in the Zeitoun neighborhood of Gaza during Israeli artillery shelling.  Emergency medical services have also come under Israeli attack with the al-Awda hospital in Jabaliya being hit by two Israeli shells today.  The attacks have also destroyed 12 Mosques.  Since the Israeli attacks began, rocket fire from militants in Gaza has thus far killed 5 Israelis including one soldier.  

Credible media reports have indicated that the Israeli military is using White Phosphorus artillery shells in its bombing of Gaza.  ADC National Executive Director Kareem Shora said, "White Phosphorus is categorized as a chemical weapon by most governments and its use in civilian areas is banned by the 1980 Geneva Convention.  It is a violation of international humanitarian law and the laws of war to use White Phosphorus ammunition, an incendiary weapon, in civilian areas."

The UN has listed Gaza, with a population of 1.5-Million people, as the most densely populated area in the world with a population density that is higher than that of Manhattan in New York City.  White Phosphorus causes painful burn injuries to exposed human flesh.

The Israeli military used White Phosphorus ammunition during the 2006 war on Lebanon as documented by ADC in its extensive 233-page report Eyewitness Lebanon: an International Law Inquiry.  White phosphorus is an indiscriminate killer that ignites once it is exposed to oxygen, producing such heat that it bursts into a yellow flame and produces a dense white smoke.

"A concerted effort is under way requesting that members of Congress issue statements supporting Israel's right to "defend its citizens against terrorism" by continuing its military action in Gaza. It is likely that legislation in this vein will emerge shortly after Congress convenes on January 6."

We may be certain that AIPAC and its allies will be pushing this hard.

Please immediately call your House member and Senators and urge them to oppose this resolution and issue a statement condemning the disproportionate Israeli actions against the citizens of Gaza.

Through ten days of attacks on the occupied Gaza Strip, Israel has killed at least 530 Palestinians with U.S. weapons in violation of U.S. law as it launches its ground invasion.

Israel's attacks come on top of a brutal siege of the Gaza Strip, which has created a humanitarian catastrophe of dire proportions for Gaza's 1.5 million Palestinian residents by restricting the provision of food, fuel, medicine, electricity, and other necessities of life.

Make no mistake about it -- Israel's war and siege on the Gaza Strip would not be possible without the jets, helicopters, ships, missiles, and fuel provided by the United States.

From 2001-2006, the United States transferred to Israel more than $200 million worth of spare parts to fly its fleet of F16's and more than $100 million worth of helicopter spare parts for its fleet of Apaches. In July 2008, the United States gave Israel 186 million gallons of JP-8 aviation jet fuel and signed a contract to transfer an addition $1.9 billion worth of littoral combat ships to the Israeli navy. Last year, the United States signed a $1.3 billion contract with Raytheon to transfer to Israel thousands of TOW, Hellfire, and "bunker buster" missiles.

Additional troubling details continue to emerge about the misuse of U.S. weapons by Israel:

* Israel is dropping GBU-39 small diameter bombs on the Gaza Strip. According to weapons experts, these bombs contain uranium oxide and have left behind radioactive contamination in places such as Kosovo, Iraq, and Afghanistan. In September 2008, Boeing received a $77 million contract to transfer 1,000 of these bombs to Israel.

* On December 30, the Israeli navy intentionally rammed a boat in international waters which was carrying medical supplies to the Gaza Strip, nearly causing it to sink. The passengers of The Dignity included doctors and recent Green Party Presidential candidate Cynthia McKinney. In July 2008, the United States signed a contract to transfer $1.9 billion of naval combat ships to Israel.
